General Terms and Conditions (AGB)
§ 1 Scope
These terms apply to all orders placed by consumers and businesses through the online shop markenhub.shop with Nxtgia Brands UG (haftungsbeschränkt), Spanger Str. 38, 40599 Düsseldorf (hereinafter “we”). Deviating terms of the customer only apply if we expressly agree to them. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
§ 2 Conclusion of contract
The presentation of products in the shop is not a legally binding offer but an invitation to order. By clicking the order button you submit a binding offer to buy the goods in your cart. We confirm receipt of your order immediately by email; this confirmation is not yet an acceptance. The contract is concluded when we expressly confirm the order by email or ship the goods. When paying by PayPal or credit card, the contract is concluded as soon as the payment process is completed. The contract language is German. We store the contract text and send it to you with the order confirmation.
§ 3 Personalized products
For personalized products (e.g. engravings, prints, NFC profiles) we use texts, names, links and logos exactly as you submit them with your order or by email. Please check spelling, characters and links carefully; we are not liable for errors in the information you provide. If you chose the “With logo” option, send logos and graphics after ordering to hallo@markenhub.shop, stating your order number. Production only begins once all required information has been received.
You confirm that you hold the necessary rights to the texts, logos, trademarks and images you submit and that their use does not infringe any third-party rights. You indemnify us against third-party claims arising from any such infringement. We reserve the right to refuse orders with unlawful, offensive or discriminatory content.
Minor, technically unavoidable variations in colour, wood grain, engraving depth and placement do not constitute a defect.
§ 4 Prices and shipping costs
All prices are final prices including statutory VAT. Any additional shipping costs are shown on the page Shipping & payment and before you complete your order. For deliveries to countries outside the EU, customs duties and import taxes may apply, which are borne by the customer.
§ 5 Payment
The available payment methods are shown during checkout. For prepayment, transfer the invoice amount within 7 days of ordering to the account stated in the order confirmation; production starts once payment is received.
§ 6 Delivery
We deliver within Germany, to the EU and to selected other countries. The delivery time is stated in the product description or on the Shipping & payment page. For personalized products, the delivery period starts once all personalization details and, where applicable, payment have been received.
§ 7 Retention of title
The goods remain our property until paid for in full.
§ 8 Right of withdrawal
Consumers have a statutory right of withdrawal, see Cancellation policy. The right of withdrawal does not apply to goods that are not prefabricated and are made according to the consumer's individual choice or specification, or that are clearly tailored to the consumer's personal needs (§ 312g (2) no. 1 BGB). This applies in particular to engraved, printed or otherwise personalized items.
§ 9 Warranty
Statutory warranty rights apply. Please report obvious transport damage as soon as possible to hallo@markenhub.shop; this does not affect your statutory rights.
§ 10 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
§ 11 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protective provisions of the country of their habitual residence. If the customer is a merchant, the place of jurisdiction is Düsseldorf.
